On May 12, 2020, the Office of the U.S. Trade Representative (USTR) announced that just thirteen (13) exclusions from the fourth round of Section 301 tariff exclusions on List 1 goods will be granted extensions.

As the exclusions for the fourth round of Section 301 goods (covering List 1) were set to expire on May 14, 2020, this means that the thirteen (13) identified products will retain their exclusionary status from additional tariffs until December 31, 2020.

The following two (2) HTS codes that were FULL exclusions were granted an extension, and they will retain their exclusionary status until December 31st:

  • 8481.10.0090
  • 8483.50.9040

The following eleven (11) HTS codes that were PARTIAL exclusions were granted an extension, and they will retain their exclusionary status until December 31st:

  • 8421.21.0000 – Filtering or purifying machinery or apparatus of a kind used for waste water treatment 
  • 8421.39.8015 – Air purification equipment, electrically powered, weighing less than 36 kg 
  • 8481.90.9040 – Armatures designed for use in hydraulic solenoid valves
  • 8481.90.9040 – C-poles, of steel, designed for use in hydraulic solenoid control valves 
  • 8481.90.9040 – Metering spools, of aluminum, designed for use in hydraulic solenoid control valves 
  • 8481.90.9040 – Metering spools, of steel, designed for use in hydraulic solenoid control valves 
  • 8481.90.9040 – Poles, of steel, designed for use in hydraulic solenoid control valves 
  • 8481.90.9040 – Push pins, of steel, designed for use in hydraulic solenoid control valves
  • 8481.90.9040 – Retainers, of steel, designed for use in hydraulic solenoid control valves
  • 9011.10.8000 – Stereoscopic microscopes, not provided with a means for photographing the image, valued not over $500 per unit
  • 9011.90.0000 – Adapter rings, tubes and extension sleeves, stands and arm assemblies, stages and gliding tables, eye guards and focusing racks, all the foregoing designed for use with compound optical micro­scopes

The USTR failed to mention the remaining products that were included in the fourth round of goods excluded from Section 301 (List 1) tariffs; this leads us to believe that the exclusionary status of these products will expire on May 14, 2020.
