On May 9, the USTR released a fourth round of exclusions. This list includes an additional 40 HTS subheadings that are either partially or completely excluded from Section 301 List 1 tariffs.

The official notice contains five (5) HTS subheadings completely excluded from 25% tariffs, covering 86 separate import requests, and thirty-five (35) partially excluded HTS subheadings, which cover another 429 requests respectively.

The latest round of exclusions will retroactively apply to all products meeting the specified criteria effective July 6, 2018 – the date the U.S. first imposed an additional 25% duties on $34 billion of Chinese products. As was the case with other exclusions, all importers who have an eligible product are still able to claim an exemption under the new exclusions for up to a year from the date the official notice is posted in the Federal Register.

The list of 5 HTS subheadings that have been completely excluded from the List 1 25% tariffs are as follows:

  • 8407.21.0040, 8427.10.4000, 8473.40.1000, 8481.10.0090 and 8483.50.9040.

The list of 35 HTS subheadings that have been granted partial exclusion from the List 1 25% tariffs are as follows:

  • 21.0000, 8421.39.8015, 8428.39.0000, 8438.80.0000, 8481.90.9040, 8501.10.4060, 8501.52.8040, 8505.90.7501, 8526.92.5000, 8529.90.8100, 8536.49.0075, 8536.50.9035, 8536.50.9040, 9011.10.8000, 9011.90.0000 and 9018.20.0040.
