The Office of the U.S. Trade Representative (USTR) released additional sets of product exclusions from Section 301 Chinese tariffs. The USTR notices feature several announcements, each containing the specially prepared HTS subheadings excluded from either List 1, 2 and 3 tariffs.

The List 3 notice contains 35 HTS subheadings partially excluded from 25% tariffs, and 9 completely excluded, which cover 75 separate requests. The latest List 3 exclusions will retroactively apply to all products meeting the specified criteria effective September 24, 2018 and will expire on August 7, 2020.

The List 1 notice partially excludes HTS subheading 9030.90.4600 – which covers parts and accessories for articles within HTS subheading 9030.10 – from 25% tariffs. However, the USTR announced that additional List 1 product exclusion will apply from July 6, 2018 through October 1, 2020.

The List 2 notice makes technical fixes and amended notes to the HTSUS.

All importers who have an eligible product are able to claim an exemption under the new exclusions, regardless of whether the importer filed an exclusion request.

The USTR will continue to issue decisions on pending exclusion requests on a periodic basis.
