USTR Releases Second Round of Section 301 List 1 Exclusion Extensions

On Friday, March 13, the Office of the U.S. Trade Representative (USTR) announced that just 11 (eleven) exclusions from the second round of Section 301 tariff exclusions on List 1 goods will be granted extensions.

As the exclusions for the second round of List 1 goods were set to expire on March 25, 2020, this means that the 11 (eleven) identified products will retain their exclusionary status from additional tariffs for another year (until March 25, 2021).

The following 2 (two) HTS codes that were FULL exclusions were granted an extension, and they will retain their exclusionary status until March 25th, 2021:

  • 8412.21.0045
  • 8607.21.1000

The following 9 (nine) HTS codes that were PARTIAL exclusions were granted an extension, and they will retain their exclusionary status until March 25th, 2021:

  • 8421.21.0000 – Machinery for filtering water, submersible, powered by batteries, manually operated, such machinery designed for use in pools, basins, aquariums, spas or similar contained bodies of water

The USTR failed to mention the remaining products that were included in the second round of List 1 goods excluded from Section 301 tariffs, this leads us to believe that the exclusionary status of these products will expire on March 25, 2020.
